Firmus Technologies has started development work at its Wesley Vale site in north-west Tasmania without a planning permit, prompting Latrobe Council to investigate whether the activities breach approved environmental conditions.
Council Investigates Unauthorised Works
Latrobe Council is assessing whether Firmus Technologies has conducted illegal works on the site of its yet-to-be-approved project. Mayor Peter Freshney said the approved forest practices plan allows activities such as tree felling, stump removal, mulching and weed suppression, but the work underway appears to go beyond that scope.
Cr Freshney said there were transportable buildings, piles of dirt and blue metal on site. He said the council had asked Firmus to stop work while assessments are conducted and warned that a formal stop-work order would be issued if the activities fall outside the approved plan.
Firmus Defends Its Actions
A Firmus spokesperson said the works were part of general site maintenance, separate from the development application. The company said these activities do not require planning approval and will take approximately four weeks to complete, with no main works associated with the broader projects commencing until all required approvals are in place.
Firmus has committed in writing to working with the council, but Cr Freshney said undertaking work without permits is not consistent with that written commitment. The company also announced it wants to build a research and development facility at Wesley Vale, which would go through a separate approval process to the proposed AI data centre.
Community and Government React
Residents in the Wesley Vale area received a letter from Planning Minister Kerry Vincent stating he was considering the request to assess the proposal as a major project. Premier Jeremy Rockliff has previously rejected the idea, stating the current planning process was adequate, but the council has deferred making a decision on the development application.
Greens MP Tabatha Badger praised the council for intervening, saying despite the lack of AI infrastructure guardrails, there are still laws in the state that must be complied with. She questioned whether Firmus thinks it can get a free kick just because it sponsored the Tassie Devils.
