Go'aanka Agoosto 24 ee maxkamadda ayaa muujinaya sida ay u shaqeyn karaan hay'adaha dimuqraadiga ah
Maxkamadda Sare ee Soomaaliya waxay 24-kii Agoosto tirtirtay doorashadii baarlamaanka iyo golayaasha deegaanka ee Galmudug, waxayna amartay doorasho cusub. Go'aanku wuxuu dhaliyay dood ku saabsan dastuuriyadda, iyadoo guddiga doorashada uu aqbalay xukunka.
Doorashadii Galmudug iyo xukunkii maxkamadda
Codbixiyayaal tiradoodu dhan tahay 197,971 ayaa 30-kii Luulyo cod ku baahiyay 11 degmo oo Galmudug ah, taasoo ahayd doorashadii ugu horreysay ee tooska ah ee baarlamaanka iyo golayaasha deegaanka. Doorashadu waxay qayb ka ahayd dadaalka Soomaaliya ee loo qaaday hal-qof-hal-cod ka dib sanado badan oo habab aan toos ahayn laga isticmaali jiray.
Maxkamadda Sare waxay go'aamisay in guddigu uusan u maamulin doorashada si waafaqsan dastuurka iyo sharciga doorashada, sidaas darteedna natiijadii la shaaciyey waa la tirtiray. Guddiga Qaranka ee Madax-bannaan ee Doorashooyinka iyo Soohdimaha ayaa aqbalay xukunka isagoo xusay doorka dastuuriga ah ee maxkamadda iyo sarraysiinta sharciga.
Falcelinta siyaasadeed iyo muhiimadda dastuuriga ah
Xildhibaan hore iyo wasiir hore Ahmed Isse Awad ayaa xukunka ku tilmaamay 'bold and brave decision' wuxuuna yiri wuxuu Soomaaliya gelin karaa 'set Somalia on the path to constitutionalism and the rule of institutions'. Wuxuu kaloo uga baaqay garsoorayaasha inay 'remain steadfast' dhanka madax-bannaanida garsoorka.
Qiimaha go'aanka ayaa ku xiran inuu noqdo bilow qaab dhismeed ay maxkamaduhu eegaan go'aamada xasaasiga ah oo ay xukumaan hay'adaha awoodda leh. Garsoor siyaasadda u roon oo la ammaano, kunawa mid ka soo horjeeda la dhaleeceeyo, ma dhiso dastuuriyadda loo baahan yahay.
Tallaabooyinka soo socda ee doorashada cusub
Diiwaangelinta cabashooyinka doorashada iyada oo loo marayo maxkamaduhu waa fursad, ee ma aha guul dimuqraadi ah ilaa hadda. Guddigu waa inuu wax ka qabtaa cilladihii keentay tirtirka, una qabtaa doorasho dib-u-cusub oo sharciga u adkaysan kara.
Haddii Galmudug ay ku soo laabato sanduuqa codbixinta si waafaqsan heerarka maxkamaddu dalbatay, tirtirka doorashadii qaldan waxay xoojin kartaa horumarka dimuqraadiga Soomaaliya. Cod-bixiyuhuna wuxuu xaq u leeyahay inuu filayo in doorashadu u hoggaansanto sharciga.
Somalia's Supreme Court annulled Galmudug's first direct parliamentary and local council elections on August 24, declaring the process unconstitutional and ordering a fresh vote. The decision marks a significant test of judicial authority in the country's transition toward direct democracy.
The Court's Decision and Electoral Context
On August 24, the Supreme Court ruled that the National Independent Electoral and Boundaries Commission had not conducted the July 30 vote in accordance with the constitution and electoral law. The court annulled the results and ordered fresh elections, a move that carries significant weight given the stakes of Galmudug's first direct election for its regional parliament and local councils.
A total of 197,971 voters cast ballots across 11 districts in the contested election. The Supreme Court's intervention underscores the principle that elections must follow agreed rules, and those rules must be enforceable. The commission accepted the judgment, citing the court's constitutional role and the supremacy of the law, and said it would announce a date for a rerun.
A Milestone for Constitutional Government
Former foreign minister Ahmed Isse Awad described the ruling as a milestone for constitutional government, praising the judges for what he called a 'bold and brave decision'. He said the judgment could 'set Somalia on the path to constitutionalism and the rule of institutions' and urged the judiciary to 'remain steadfast' in safeguarding its independence.
The decision has generated unusually strong reactions from Somali political figures who see consequences extending far beyond Galmudug. The lasting value of the ruling will depend on whether it represents the beginning of a pattern in which courts can scrutinise politically sensitive decisions, rule against powerful institutions and expect their judgments to be implemented.
Looking Ahead: The Rerun Test
The Galmudug ruling is an opportunity, not yet a democratic victory. The electoral commission cannot treat the judgment simply as an instruction to select another polling date. It must address the shortcomings that led the Supreme Court to invalidate the first election and organise a rerun that can withstand legal scrutiny.
If electoral grievances can be channelled through credible legal processes, examined by courts and resolved through binding judgments, Somalia will have strengthened an important part of its democratic architecture. The annulment of one flawed election may ultimately strengthen Somalia's democratic development more than allowing it to stand ever could.
