A Malindi Environment and Land Court has issued interim orders blocking the planned September 30, 2026 groundbreaking ceremony for the multibillion-shilling Dangote refinery in Lamu County, Kenya, pending a hearing on a petition filed by 133 land occupants.
Interim Orders Freeze Land Activities
Justice Jane Onyango certified the petition as urgent and directed that the status quo on L.R. No. 13061 in the Hindi/Manda Magogoni area of Lamu County be maintained until October 14, 2026. The court temporarily barred the Office of the President, Dangote Industries, the Lamu County Government and other respondents from clearing, excavating, fencing, demolishing, constructing on, transferring, disposing of or otherwise interfering with the portions of the land occupied by the petitioners.
The interim orders will remain in force pending further directions by the court on the application. The judge's ruling effectively suspends all preparatory work for the refinery project on the contested parcel, ensuring that the existing conditions on the land are preserved until the matter is heard again.
Petitioners Assert Long-Standing Land Rights
The 133 petitioners, led by Salim Tima Swale, moved to court seeking protection of their interests in the land, arguing that they have been in occupation and use of their respective portions for many years. They describe themselves as long-standing occupants, cultivators and farmers who have established homes and farms on the land, with crops, trees and other developments.
The applicants contend that their interests in the land are not based solely on formal registration, but also arise from their actual occupation, possession, use, cultivation and development of the property. They further argue that these interests should be recognised and taken into account in any compulsory acquisition process involving the land.
Next Hearing Scheduled for October 14
The interim orders issued by Justice Onyango will remain in force until October 14, 2026, when the matter is expected to come before the court for further directions. During this period, no activities related to the Dangote refinery project may proceed on the designated land in Lamu County.
The court's decision marks a significant legal development in the ongoing dispute over the refinery site, as it prioritises the rights of local land occupants while the broader application is reviewed. The outcome of the hearing on October 14 could determine the future of the multibillion-shilling project in Lamu.
