Phone Chomsavanh, a Laotian citizen deported by the United States to Eswatini, was released from a maximum-security prison in the African nation on Sunday after being held there for more than a year. His lawyer stated that Chomsavanh had already served his sentence in the U.S. before being sent to the Matsapha Correctional Complex near Mbabane without prior notice.
Lack of Due Process and Legal Challenges
Chomsavanh's U.S.-based lawyer, Tin Thanh Nguyen, announced that the deportee was only informed of his destination shortly before a military cargo plane landed him in Eswatini more than 14 months ago. Nguyen criticized the situation, stating, 'He sat there for more than a year. No notice, no hearing, no chance to object. That is not due process by any definition.'
The case highlights the contentious nature of the Trump administration's third-country deportation program. Last month, a U.S. appeals court upheld a ruling to halt the program because it failed to give immigrants time to challenge removal to a third country if they fear persecution. However, the U.S. Supreme Court ruled last week to temporarily allow the administration to continue swiftly removing immigrants to third countries, though it will hear arguments in December.
Broader Context of Third-Country Deportations
Chomsavanh is one of around 500 immigrants deported from the United States to African countries that are not their home nations since the program began last year, according to advocacy groups Human Rights First and Refugees International. Eswatini, Africa's last absolute monarchy, was paid $5.1 million by the Trump administration to accept deportees, having received around 30 individuals so far.
Chomsavanh and the four other immigrants he was deported with were convicted of serious crimes in the U.S. but had completed their sentences by the time they were sent to Eswatini. Nguyen noted, 'He had already served his time. Instead they put him on a plane without telling him where it was headed and left him in a prison in a country he had never heard of, where nobody ever accused him of anything.' Chomsavanh has since left Eswatini and landed in Johannesburg en route to Laos.
