Rebel Wilson oo lagu abaalmariyay $359,000 kadib markii shirkadda AI Film ay ku guuldareysatay dacwadeeda
Maxkamadda Sare ee NSW waxay shirkadda AI Films ku abaalmarisay $10 oo keliya, waxayna amartay inay bixiso kharashka sharciga.
Jilaa Rebel Wilson ayaa lagu abaalmariyay $359,000 kadib markii shirkadda wax soo saarka ee UK AI Film ay ku guuldareysatay dacwadeeda ku saabsan filimkeeda The Deb, sida ay maxkamadda Sare ee NSW go'aamisay.
Dacwadda $15 milyan iyo go'aanka maxkamadda
Shirkadda AI Film waxay Rebel Wilson ku dacweysay Maxkamadda Sare ee NSW iyadoo dalbaneysa $15 milyan, iyadoo ku eedeyneysa in hadallada ay ku qortay bartiisa Instagram iyo website khiyaali ah ay filimka ka dhigeen mid aan faa'iido lahayn. Garsoore Elisabeth Peden ayaa dacwadda diiday, iyadoo go'aamisay in Wilson ay codsatay in website xun la sameeyo, laakiin aanay jirin caddayn in website-kaasi AI Film khasaare dhaqaale u geystay.
Lacagaha iyo khasaaraha filimka
Maxkamadda waxay amartay AI Films inay Camp Sugar, shirkadda Wilson, bixiso $359,000 oo ah mushahar soo saare oo aan la bixin, iyo sidoo kale kharashkeeda sharciga. Garsoore Peden waxay sheegtay in aanay ku qanacsaneyn in AI Film ay muujisay xiriir sababo leh oo u dhexeeya hadallada marin-habaabinta leh iyo khasaare kasta. Filimka The Deb wuxuu soo galay $335,000 oo keliya sanduuqa shaashadda gudaha.
Guusha labaad iyo dacwadaha socda
Kani waa guusha labaad ee Wilson, kadib markii jilaaga hormuudka filimkeeda, Charlotte MacInnes, ay sidoo kale ku guuldareysatay dacwadeeda sumcad-dilka. Wilson waxay ku mahadshey maxkamadda bartiisa Instagram maalinta Jimcaha, iyadoo sheegtay in difaacidda nafteeda ay ku timid kharash shaqsi, shucuur iyo dhaqaale oo aad u weyn. MacInnes waxay racfaan ka qaadatay khasaaraheeda, soo saarayaasha AI Film-na waxay Wilson ku dacweynayaan sumcad-dilka California.
The Supreme Court of NSW dismissed the production company's case and ordered it to pay Wilson's company $359,000 in unpaid producer fees and legal costs.
Actor Rebel Wilson has been awarded $359,000 after UK production company AI Film failed in its legal bid to sue her over her film The Deb, the Supreme Court of NSW has ruled.
Court Dismisses $15 Million Claim
AI Film sued Wilson in the Supreme Court of NSW for $15 million, claiming false statements she made on social media and through a fake takedown website had made the film unprofitable. Justice Elisabeth Peden dismissed the case, finding that although Wilson did ask for a malicious website to be created, there was no proof it caused AI Film any financial loss.
Damages, Fees and the Judge's Reasoning
The court awarded AI Film's subsidiary, AI Films, $10 in nominal damages for technical breaches of its social media contract. It ordered AI Films to pay Wilson's company, Camp Sugar, $359,000 in unpaid producer fees, as well as her legal costs. Justice Peden found statements on the website were actuated with malice on Wilson's part, but that none of the people named were AI Film producers and the company could not prove loss.
Wilson Responds as Further Cases Continue
Justice Peden said: "I am not satisfied AI Film … have demonstrated a causal connection between the misleading or deceptive representations and any loss or damage." On Instagram on Friday, Wilson thanked the court and said: "This girl never knew how much she was going to need that law degree!!" She added that defending herself had come at "an enormous personal, emotional and financial cost." The win follows the unsuccessful defamation case brought by lead actor Charlotte MacInnes, who has lodged an appeal, and AI Film's producers are also suing Wilson for defamation in California.
